FOODLAND SUPER MARKET, LIMITED – FOODLAND “SPAM-A-VERSARY WEEKEND” SWEEPSTAKES – OFFICIAL RULES

NO PURCHASE NECESSARY

1. PROMOTION PERIOD:

The Foodland Super Market, Limited (“Foodland”) “SPAM-a-versary Weekend” Sweepstakes (“Sweepstakes”), begins at 12:00:01 AM Hawaii-Aleutian Standard Time (HAST) on Friday, May 26, 2023 and ends at 11:59:59 PM on Monday, May 29, 2023 (“Entry Period”).

2. ELIGIBILITY:

The Sweepstakes is open only to legal U.S. citizens residing in Hawaii who are 21 years of age or older as of May 29, 2023.  No purchase necessary and need not be present to win.  A purchase does not increase chances of winning.  The following individuals are ineligible to participate in the Sweepstakes:   

1. Directors, officers, employees, and agents of Sponsor or Foodland, and its parent companies, subsidiaries, affiliates, and advertising and promotional agencies.
2. The immediate families of the group in section 2.a., including, but not limited to, their spouses, children, siblings, parents, in-laws, grandmothers, grandfathers, grandchildren, and any spouse thereof.
3. A person residing in the same household as any of the groups in sections 2.a. and 2.b.

3. HOW TO ENTER:

During the Entry Period, May 26-29, 2023, enrolled Maika’i members who purchase four (4) or more cans of SPAM at any Foodland location will be automatically entered to win. Limit one entry per person. All entries become the sole and exclusive property of Foodland and receipt of entries will not be acknowledged or returned. Foodland will not be responsible for entries excluded or deemed ineligible due to reasons beyond its control, including, but not limited to incomplete, illegible or unintelligible entries, or technological failures of any kind, or reasons due to the method of delivery or service. Foodland Maika’i members who have enrolled prior to May 29, 2023 will be eligible for the sweepstakes.

To enter without making a purchase, hand write your full name, daytime and evening telephone numbers, email address, valid residential address (no P.O. Box addresses) on a 3”x5” index card and mail in a first-class postage prepaid envelope (“envelope”) to: Foodland “SPAM-a-Versary Weekend Sweepstakes”, c/o Foodland Super Market, 3536 Harding Ave., Honolulu, HI 96816. Each valid entry made by mailed index card will be entered into the drawing and shall be voided thereafter.  Limit one index card per envelope. Mailed entries must be postmarked by May 29, 2023 and received by June 1, 2023. Hand-delivered, mass produced, mechanically/digitally produced, machine printed, or typewritten entries will not be accepted.

All entries become the sole and exclusive property of Foodland and receipt of entries will not be acknowledged or returned.  Foodland will not be responsible for entries excluded or deemed ineligible due to reasons beyond their control, including, but not limited to, lost, late, insufficient postage, mutilated, incomplete, illegible, postage-due or unintelligible entries, or technological failures of any kind, or reasons due to the method of delivery or service. 

Entrants may earn multiple entries for performing promotional tasks as outlined by Foodland during the promotion period. Otherwise, entries are limited to one per person.

4. RANDOM DRAWINGS AND PRIZES:

Prize: One (1) winner (“Winner”) will receive one year’s worth of SPAM (“Prize”) in the form of twelve (12) cases of Hormel Classic SPAM or one hundred forty four (144) cans of Hormel Classic SPAM, 12 oz. The value of this prize is five hundred forty five dollars and seventy six cents ($545.76) or three dollars and seventy nine cents ($3.79) per can.

Winner will be selected in a random drawing conducted by Foodland, on or about June 2, 2023, from among all eligible entries received. Odds of winning are dependent upon the number of eligible entries received. Winners will be notified by phone and/or email. In Foodland’s sole discretion, an alternate Winner may be drawn in the event Foodland is unable to contact any Winner.  Winners are responsible for any and all federal, state and local taxes, if applicable, and must provide Foodland with valid identification and a valid taxpayer identification number or social security number on an IRS Form W-9 before any Prize will be awarded.  Winners must be at least twenty-one (21) years of age to collect and redeem the Prize.  A valid identification and showing proof of age shall be required.

The winner will be required to sign a Declaration of Eligibility and Release of Liability before the Prize can be awarded.  Failure to sign and return the Declaration of Eligibility and Release of Liability within ten (10) calendar days may result in a Prize winner’s disqualification, the forfeiture of his or her interest in the Prize, and the award of the Prize to an alternate Prize winner in Foodland’s sole discretion. 

5. GENERAL:

By entering the Sweepstakes, you agree: (a) to be bound by the Sweepstakes Rules; (b) to release and hold harmless Foodland, including its stockholders, directors, officers, employees, subsidiaries, agents, Prize suppliers, and representatives from any liabilities, claims, damages, or losses arising out of or relating in any way to the information provided for your entry in the Sweepstakes, your breach of any of the Sweepstakes rules, or your acceptance, use, misuse, or possession of any Prize received in the Sweepstakes; and (c) to allow Foodland to use, without additional compensation, notice, stipulation, or approval, your name or photo and/or likeness and other personal information for advertising or publicity purposes in any media; and (d) to bear sole responsibility for any taxes or other liabilities and obligations resulting from the acceptance and use of your Prize.

The Sweepstakes is subject to change without notice and all judgments and decisions made by Foodland are final.  Inaccurate, fraudulent, or falsified entries or failure to comply with the Sweepstakes rules may result in disqualifications or forfeiture of Prizes in the sole discretion of Foodland.

Foodland does not provide any warranties or guaranties with respect to the Prizes, expressed or implied, including, but not limited to the implied warranties or guaranties of merchantability, appropriateness, fitness for a particular purpose, competency, safety, or security of the Prizes.

If any provision of the Sweepstakes Rules is held to be unenforceable, it will be modified so that it is enforceable to the maximum extent permitted under applicable law and all other terms will remain in full force. If the unenforceable provision cannot be so modified, it will be excluded from the Sweepstakes Rules, and all other terms of the Sweepstakes Rules will remain in full force.

The Sweepstakes Rules may not be altered, amended, changed, waived, terminated or modified in any respect or particular unless the same shall be in writing and consented to by Sponsor and Foodland.  No failure or delay of Sponsor or Foodland in exercising any right, power, or privilege hereunder shall operate as a waiver of any such right, power, or privilege; no single or partial exercise of any such right, power or privilege shall preclude any other or further exercise thereof; and no waiver of any of the provisions of the Sweepstakes Rules shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, and no waiver shall constitute a continuing waiver.

The Sweepstakes Rules shall be construed, governed and enforced in accordance with the laws of the State of Hawaii without giving effect to principles of conflict of laws.

The Sweepstakes is void where prohibited or restricted by law, and subject to all applicable federal, state, and local laws.  some restrictions may apply.
